Angebot ist eine empfangsbedürftige Willenserklärung, die alle wesentlichen Vertragsbestandteile enthält.
Willenserklärung
Unter einer Willenserklärung versteht man die Äußerung eines Willens der auf eine privatrechtliche Rechtsfolge gerichtet ist.
Konsens
Konsens bedeutet, dass sich zwei bereits ausgelegte Willenserklärungen bezüglich aller Punkte, die nach der Erklärung auch nur einer Partei getroffen werden sollen inhaltlich decken
Äußerer Handlungswille (Erklärungstatbestand)
Aus der Sicht eines objektiven Geschäftspartners muss das Verhalten des Erklärenden überhaupt als willensgesteuerte Handlung erscheinen.

Aus der Sicht eines objektiven Geschäftspartners muss das Verhalten des Erklärenden auf eine ganz bestimmte Rechtsfolge gerichtet sein.
Zugang der Willenserklärung
Zugegangen, wenn die verkörperte Willenserklärung gem. § 130 BGB dann, wenn sie derart in den Machtbereich des Empfängers gelangt ist, dass dieser unter normalem Verlauf der Dinge die Möglichkeit der Kenntnisnahme hat.
