Generelle Anspruchsprüfung - Anspruch erloschen?
Rechtsfolge der Unmöglichkeit aus § 275 ist der Leistungsausschluss des Schuldners -> Anspruch des Gläubigers ist erloschen.
Prüfung Schadensersatz - §§ 280 I, III, 283 BGB.

§ 275 III -> Ausschluss der Leistungspflicht bei Unzumutbarkeit höchstpersöhnlicher Leistung
Wann liegt Unmöglichkeit iSd. § 275 I vor und welche Varianten der echten Unmöglichkeit beinhaltet § 275 I?
Unmöglichkeit nach § 275 I BGB liegt vor, wenn der geschuldete Leistungserfolg endgültig nicht mehr herbeigeführt werden kann.
Unterschieden werden muss zwischen objektiver (“für jedermann”) und subjektiver (“für den Schuldner”) Unmöglichkeit.
Wann handelt es sich um objektive Unmöglichkeit iSv. § 275 BGB?
Objektive Unmöglichkeit ist gegeben, wenn die Leistung von keinem Menschen erbracht werden kann.
Dies ist der Fall, wenn die Leistung nach den Naturgesetzen oder dem Erkenntnisstand von Wissenschaft und Technik nicht erbracht werden kann.
Wichtig: Auch die theorietische Möglichkeit der Leistungserbringung muss ausgeschlossen sein!
Kommen neben tatsächlichen Gründen auch andere Gründe in Betracht, weshalb ein Leistungsausschluss nach § 275 I BGB vorliegen kann?
Neben tatsächlichen Gegebenheiten können auch rechtliche Hindernisse einen Ausschluss des Leistungsanspruchs des Gläubigers nach sich ziehen.
Bsp.:
Behördliches Veräußerungs- oder Vermietungsverbot (Drogen, Pandemie)
Wann tritt objektive Unmöglichkeit bei einer Gattungsschuld ein?
Objektive Unmöglichkeit tritt bei einer Gattungsschuld erst mit Untergang der gesamten Gattung ein.
Ausnahmen:
Konkretisierung der Gattungsschuld, § 243 II BGB
Leistungsgefahr obliegt dem Gläubiger, § 300 II BGB
Wann tritt objektive Unmöglichkeit bei einer Dienstleistung ein?
Verspricht der Schuldner eine nach den Naturgesetzen und dem Kenntnisstand der Wissenschaft und Technik nicht erbringbare Leistung, liegt objektive Unmöglichkeit hinsichtlich der Dienstleistung vor.
Bsp.: S verpflichtet sich zur Vorhersage der Zukunft, etc. (Achtung Vetragsauslegung: zu prüfen ist, ob tatsächlich der Einsatz magischer Kräfte oder nur die Belustigung vereinbart wurde)
Kann Unmöglichkeit auch bei Nichteinhaltung der Leistungszeit vorliegen?
Ist die vereinbarte Leistungszeit für die Leistung so wesentlich, dass die Leistung nur zur Leistungszeit erbracht und später nicht nachgeholt werden kann (Fixgeschäft), tritt bei Nichteinhaltung der Zeit Unmöglichkeit nach § 275 I BGB ein.
Wann handelt es sich um subjektive Unmöglichkeit iSv. § 275 I BGB?
Subjektive Unmöglichkeit (Unvermögen) liegt vor, wenn die Leistung zwar von einem Dritten, aber (aus tatsächlichen oder rechtlichen Gründenn) nicht vom Schuldner erbracht werden kann.
Wichtig: § 275 I BGB liegt nur dann vor, wenn der Schuldner die Leistung auch theoretisch nicht erfüllen kann!
Keine Unmöglichkeit, wenn S die Sache (wieder-) beschaffen könnte.
Bsp.: das geschuldete Buch wurde gestohlen, der Dieb ist nicht auffindbar. Dasselbe Buch gibt es aber noch bei Thalia.
Subjektive Unmöglichkeit, wenn der Schuldner zahlungsunfähig ist?
Das finanzielle Unvermögen des Schuldners befreit diesen nicht von seiner Leistungpflicht. § 275 I BGB ist nicht einschlägig, denn Geld hat man zu haben.
Subjektive Unmöglichkeit, wenn der Schuldner außerstande ist, die Leistung zu erbringen, ein Dritter die Leistung jedoch ebenfalls erbringen könnte?
Subjektive Unmöglichkeit ist auch dann gegeben, wenn Umstände vorliegen, aufgrund welchen der Schuldner zur Erbringung einer höchstpersönlichen Leistung, außerstande ist.
Erbringung der Arbeitsleistung -> Schuldner ist arbeitsunfähig krank.
Inwiefern wirkt sich eine bei Vertragsschluss bereits bestehende Unmöglichkeit auf die Wirksamkeit eines Vertrags aus?
Welche Relevanz kommt der Unterscheidung zwischen anfänglicher und nachträglicher Unmöglichkeit zu?
§ 311a I BGB -> anfängliche Unmöglichkeit steht einem wirksamen Vertragsschluss nicht im Wege.
§ 275 I BGB unterscheidet nicht zwischen anfänglicher und nachträglicher Unmöglichkeit -> Wortlaut: “Unmöglich ist”
Die Unterscheidung von anfänglicher und nachträglicher Unmöglichkeit bestimmt lediglich, welche SchE AGL einschlägig ist.
anfängliche: § 311a II BGB
nachträglich: §§ 280 ff.
Inwiefern wirkt sich eine teilweise Unmöglichkeit auf die Leistungspflicht aus?
Sofern die Leistung teilbar ist und ein Teil dieser Leistung nicht erbringbar ist, entfällt die Leistungspflicht des Schuldners insoweit er die Leistung nicht erbringen kann.
Wichtig: § 266 BGB -> Schuldner ist zur Teilleistung nicht berechtigt, d.h. -> hat Gläubiger kein Interesse an der Teilleistung kann dieser SchE nach §§ 280 I, III, 283 BGB (bzw. §§ 331 a II 1 iVm § 281 I 2 BGB) verlangen.
Inwiefern wirkt sich eine vorübergehende Unmöglichkeit auf die Leistungspflicht aus?
§ 275 I BGB trifft keine konkrete Regelung -> Spielraum für Analogien.
h.M.: Ausschluss der Leistungspflicht nur für den Zeitraum, in welchem das Leistungshinderniss besteht.
Grundsatz: S leistet nicht fristgemäß; Gl. hat S unter Fristsetzung zur Leistung aufzufordern und kann nach fruchtlosem Fristablauf nach § 323 BGB analog vom Vertrag zurücktreten und (bei Vt.-Müssen des Schuldners) SchE statt der Leistung nach § 280 I, III, 281 BGB analog fordern.
-> Analogie setzt eine planwidrige Regelungslücke und eine vergleichbare Interessenlage voraus. Hier: Keine Regelung in § 275 BGB + Gl. soll bei vorübergehender Unmöglichkeit nicht schlechter gestellt sein, als bei einer “einfachen” Leistungsverzögerung.
Variante 1: S hat Leistungshindernis zu vertreten; Leistungserbringung erfolgt verzögert -> Verzögerungsschaden, § 280 I, III, 286 BGB neben der Leistung.
Variante 2: vorübergehende Unmöglichkeit stellt die Verwirklichung des Vertragszwecks in Frage und dem Gläubiger bzw. Schuldner ist das Festhalten am Vertrag nicht zumutbar -> Wegfall der Leistungspflicht nach § 275 BGB trotz späterer Leistungserbringungsmöglichkeit.
Wie wirkt sich die vorübergehende Unmöglichkeit auf die Leistungspflicht aus, wenn es sich um ein absolutes Fixgeschäft handelt?
Ist die vereinbarte Leistungszeit derart wesentlich, dass die Leistung später nicht nachgeholt werden kann (abolutes Fixgeschäft), ist der Leistungshindernis aber nur vorübregehender Natur, ist § 275 BGB trotzdem unmittelbar anwendbar -> Eine spätere Leistungserbringung kann den vereinbarten Erfolg nicht herbeiführen.
Inwiefern wirkt sich die vorübregehende Unmöglichkeit auf ein relatives Fixgeschäft aus?
Relatives Fixgeschäft: Die Leistung kann prinzipiell nachgeholt werden und dem Schuldner ist bei Vertragsschluss darüber in Kenntnis, wie wichtig die (vertraglich vereinbarte oder anderweitig mitgeteilte) Leistungszeit für den Gläubiger ist. (Geburtstagsgeschenk; etc.)
Kein Fall der Unmöglichkeit -> Es greift § 323 II Nr. 2 BGB; Gl. kann ohne Fristsetzung vom Vertrag zurücktreten.
Wonach bestimmt sich, ob ein absolutes oder relatives Fixgeschäft vorliegt?
Maßgeblich ist die Frage, ob das Leistungsinteresse aufgrund der Verspätung entfällt.
Welche Rolle spielt das Vertretenmüssen im Rahmen der Unmöglichkeit?
Unmögliches ist nicht geschuldet -> Vertretenmüssen demnach irrelevant.
Welcher prozessuale Unterschied liegt zwischen § 275 I und II, III BGB?
Unmöglichkeit aus § 275 I BGB ist vAw zu berücksichtigen -> Einrede muss nicht erhoben werden.
§ 275 II und III sind Leistungsverweigerungsrechte, mithin Einreden und müssen demnach eigenständig geltend gemacht werden.
Wann liegt ein Fall des § 275 II BGB vor?
Praktische Unmöglichkeit
Denkbar ist das Vorliegen eines Leistungsausschlusses nach § 275 II BGB - praktische Unmöglichkeit.
-> § 275 II 1 BGB abschreiben.
Die Feststellung eines groben Missverhältnisses erfordert eine Interessenabwägung im Einzelfall.
-> es müssste sich um eine völlig unsinnigen Aufwand handeln.
Konkretisierung des groben Missverhältnisses aus § 275 II BGB
Erfoderlich ist eine Abwägung zwischen dem Aufwand, den der Schuldner für die Erfüllung seiner Leistung erbringen müsste und dem Nutzen, den die Leistung für den Gläubiger hätte.
Für ein ausgeprägtes Leistungsinteresse seitens des Gläubigers sprechen:
überwiegend materielle Interessen (Weiterverkaufserlös; etc,)
in Einzelfällen auch das immatrielle Interesse (Liebhaberinteresse)
Für einen großen Aufwand des Schuldners sprechen
Einsatz eigener Arbeitskraft
sonstige persönliche Anstrengungen
Sind immaterielle Belastungen des Schuldners durch die Leistungserbringung bei der Bestimmung eines groben Missverhältnisses zu berücksichtigen?
Nein -> persönliche Beeinträchtigungen finden in § 275 III BGB eine selbstständige Regelung.
Inwiefern ist es zu berücksichtigen, ob der Schuldner das Leistungshindernis zu vertreten hat oder nicht? (§ 275 II 2 BGB).
§ 275 II 2 BGB besagt, dass der Schuldner größere Anstrengungen unternehmen muss, wenn dieser das Leistungshindernis zu vertreten hat.
Im Umkehrschluss dazu müssen die Anforderungen an den Aufwand des Schuldners deutlich herabgesenkt werden, wenn dieser den Umstand, auf welchem das Leistungshindernis beruht, nicht zu verantworten hat.
Welche Bedeutung hat die praktische Unmöglichkeit hinsichtlich des Nacherfüllungsanspruchs aus §§ 437 Nr. 1, 439 IV BGB?
§§ 437 Nr. 1, 439 BGB spricht dem Gläubiger den Anspruch auf Nacherfüllung zu bie Lieferung einer mangelhaften Sache zu.
Nach § 439 IV BGB kann der Schuldner die Nacherfüllung in Firm der Mängelbeseitigung verweigern, wenn diese mit unverhältnismäßig hohen Kosten verbunden ist.
Ein Fall des § 275 II BGB soll jedoch dann bereits vorliegen, wenn die Kaufsache nur einen geringen Mangel aufweist und dieser sich trotz sehr hohem Aufwand nur partiell beseitigen lässt.
Welche Besonderheiten gibt es bei der praktischen Unmöglichkeit hinsichtlich der Gattungsschuld zu berücksichtigen?
Schuldner einer Gattungsschuld übernimmt das Beschaffungsrisiko -> RF des Beschaffungsrisikos ist eine strengere Schuldnerhaftung, d.h. der Schuldner hat ein Leistungshindernis auch ohne eigenes Verschulden zu vertreten.
Eine solche Risikoübernahme ist innerhalb der Prüfung eines groben Missverhältnisses zu bercksichtigen und dem Schuldner anzulasten.
Wann liegt ein Fall des § 275 III BGB vor?
Klausuraufbau
§ 275 III BGB regelt die Leistungsbefreiung des Schuldners aufgrund persönlicher Unzumutbarkeit.
-> Sondvorschrift für SV, in welchen der S die Leistung persönlich erbringen muss, dies aber aufgrund dessen persönlicher Situation für ihn unzumutbar ist.
Klausur:
Möglicherweise könnte der Schuldner die Leistung aufgrund persönlicher Unmöglichkeit verweigern.
-> § 275 III BGB abschreiben.

Wann ist dem Schuldner die Leistungserbringung aus persönlichen Gründen unzumutbar?
Es bedarf einer Abwägung zwischen dem Gewicht des Leistungshindernisses und dem Leistungsinteresse des Gläubigers.
-> Einschlägig sind zwar nicht nur existenzielle Extremfälle, das Hindernis muss jedoch von außerordentlicher Bedeutung sein.

Kann persönliche Unmöglichkeit auch mit Gewissenszweifeln begründet werden?
Liegt der Gewissenskonflikt bei Vertragsschluss noch nicht vor und war dieser bei Vertragsschluss nicht vorhersehbar, kann es in Einzelfällen geboten sein, der Gewissensfreiheit aus Art. 4 I GG den Vorrang zu lassen und persönliche Unmöglichkeit zu bejahen.
-> Vss.:
(1) Gewissenskonflikt lag bei Vertragsschluss noch nicht vor
(2) Eintreten des Gewissenskonflikt war bei Vertragsschluss nicht absehbar.
Der Schuldner muss aufgrund von § 275 BGB nicht leisten - Gl. hat KP bereits bezahlt. Wie erhält dieser seinen KP zurück?
