III. Echtes Bestätigungsschreiben
(+), nur wenn Absender der Ansicht ist, dass bereits ein Vertrag geschlossen wurde
-> sonst: lediglich Auftragsbestätigung, KBS (-)
IV. Unmittelbarer Zugang des Bestätigungsschreiben
-> muss unmittelbar nach den Vertragsverhandlungen verschickt werden und dem Empfänger zugehen, § 130 BGB
V. Genehmigungsfähigkeit des Inhalts
-> tatsächlich verhandelte Punkte müssen in Schreiben wiedergegeben werden
-> Erweiterungen oder Veränderungen möglich, aber:
=> Inhalt darf nicht so weit von den Vertragsverhandlungen abweichen, dass der Absender nicht mit dem Einverständnis des Empfängers rechnen konnte
VII. Schutzwürdigkeit des Absenders
-> Absender muss redlich sein
(-), wenn: Arglistigkeit, also bewusst unrichtige Formulierung zu eigenen Gunsten
VIII. Schweigen des Empfängers während Widerspruchsfrist
-> Frist ca. 2-5 Tage nach Zugang
Rechtsfolge: Schweigen des Empfängers gilt ausnahmsweise als Willenserklärung; Vertrag mit Inhalt des KBS kommt zustande

IV. Bestehen einer Geschäftsverbindung oder das Erbieten zum Besorgen von Geschäften
Rechtsfolge: Empfänger des Angebots muss unverzüglich (§ 121 BGB) antworten; kommt der Empfänger dieser Pflicht nicht nach, so kommt ein Vertrag mit dem Inhalt des Angebots zustande. Der Empfänger des Angebots ist daraus zur Ausführung der Geschäftsbesorgung verpflichtet, während der Anbietende die Gegenleistung erbringen muss
