Sofern sich Zusatztatsachen auf die Tat beziehen, fallen diese unter § 252 StPO.
Befundtatsachen fallen nicht unter § 252 StPO. Asonsten würde der wert des Gutachtens zu sehr leiden.

Nach der Meinung des BGH wohl nicht.
